Estimados señores:
Por medio del presente escrito, yo, D./D.ª [Nombre y apellidos], con DNI/NIE [DNI/NIE], en mi condición de titular del contrato de prestación de servicios con número de referencia [n.º de contrato], comunico de forma fehaciente mi voluntad de causar BAJA en el servicio contratado con su entidad, con efecto en la fecha más temprana legalmente posible.
Solicito expresamente que se proceda a la cancelación efectiva del servicio, que cesen todos los cargos y facturaciones a partir de la fecha de efecto indicada, y que se me facilite por escrito el número de referencia o expediente de esta baja, así como confirmación de su fecha efectiva.
De conformidad con el artículo 7 del Real Decreto 899/2009, por el que se aprueba la carta de derechos del usuario de los servicios de comunicaciones electrónicas, comunico esta baja con la antelación mínima de dos días hábiles que exige dicha norma, por lo que no deberá facturarse ni cobrarse cantidad alguna transcurrido dicho plazo. Si existiera compromiso de permanencia, solicito el desglose de la penalización aplicable, que en todo caso deberá ser proporcional al tiempo pendiente conforme al Real Decreto Legislativo 1/2007 (TRLGDCU). Solicito además confirmación por escrito del procedimiento y plazo para la devolución de cualquier equipo (router, descodificador u otro terminal) que tenga en depósito, así como del resguardo que acredite dicha devolución.
La presente comunicación es fehaciente y suficiente por sí misma para surtir plenos efectos, sin que su validez quede condicionada a ninguna confirmación telefónica. Solicito que toda gestión relativa a esta solicitud se realice exclusivamente por escrito (correo postal o electrónico) y no autorizo llamadas comerciales ni de retención. La eventual falta de respuesta telefónica por mi parte no suspenderá ni dejará sin efecto esta solicitud.
La presente comunicación se remite de forma fehaciente, con acuse de recibo y constancia de su contenido y fecha, a efectos probatorios. Quedo a la espera de su confirmación por escrito.
