Right of withdrawal: cancel within 14 days with no penalty
If you signed up online, by phone or off-premises, you have 14 calendar days to withdraw with no explanation and no penalty. Here is when it applies and how to use it.
What is the right of withdrawal?
It is the right to cancel a contract within a period, without having to justify it and without penalty. It is recognised in article 102 of Royal Legislative Decree 1/2007 (TRLGDCU) for distance contracts and those signed off-premises.
When does it apply?
- Purchases and sign-ups made online.
- Contracts made by phone.
- Contracts signed off-premises (for example, a salesperson at your home).
The period is 14 calendar days from signing the contract or, for goods, from receiving them.
Extended period if you weren't informed
If the company did not properly inform you of your right of withdrawal, the period is extended by up to 12 additional months. It is worth reviewing the information they gave you when you signed up.
Exceptions
Article 103 of the TRLGDCU sets out exceptions: for example, services already fully performed with your consent, digital content already downloaded, or personalised goods. Check whether your case falls under one before withdrawing.
How to exercise your withdrawal
Communicate it reliably within the period. A burofax with acknowledgment of receipt proves that you withdrew in time. After withdrawal, the company must refund the amounts you paid within a maximum of 14 calendar days (article 107 of the TRLGDCU).
